In the sales, when considering compensation, division of sales and proceeds, there are some elements to be considered. Firstly, Simon and Hamish have agreed under joint tenancy to continue to pay mortgages for the property and reap the income jointly. However, a separate verbal agreement exists where Simon will live in the property and will continue to pay extra for maintenance and repair costs. Simon will not be able to claim any compensation for this, as it was part of a separate agreement with Hamish, for the benefit of his living there. On the other hand, Simon has added some amenities such as the garage, the water tank and has developed an orchid garden that has a value of its own. For these additions which enhance the overall value of the property, Simon would be able to claim some extras when it comes to dividing the proceeds of the sale. It can either be determined as a per cent of values added to the property, or he could receive a compensation from Hamish before the sales is completed.
