Under Part 1 of the Consumer Guarantees Act 1993, section 6 assures the “Guarantee as to acceptable quality”. Under this section, the goods guaranteed to a customer must be of acceptable quality. Where the goods are not complying with the guarantee assured to customer, then the customer can have been right of redress against supplier or manufacturer, who in this case is Layabout. Now acceptable quality as defined for the goods or service, is where they are fit for all the purposes for which goods or service are used. Section 7 gives the provisions as needed in terms of appearance, finish, defects, safety, durability, the nature of goods, price and packaging etc. Now the goods are not of proper appearance as one would expect. It is not finished properly as some sections of the carpet was not secured to the floor properly. Not an unsecured carpet could lead to a potentially unsafe condition for Ritchie. Ritchie could fall because of the unsafe carpet and this is a breach of quality of services and products from Layabout.

Now as with any other product and service, Ritchie will have the option to call Layabout and reject the goods and ask for a refund. Section 22 and 23 of the Act make the provisions needed for this rejection. Now Ritchie can call and reject the good, and the provision would be entitled to send the good back to Layabout. However, section 22 states that in such cases where the goods in question cannot be transported without significant cost to the consumer because of the size of the goods, or the height or the weight, then the supplier should collect the goods. Therefore, layabout because of their breach of guarantee for quality to Ritchie will not be obligated to collect the goods. Per section 23, the consumer Ritchie will not have the option of refund or replacement. The consumer can choose to have a refund amount paid out to him in addition to the rejection of goods for any other consideration that consumer has provided. A refund means a cash value to be paid out to the consumer and the consumer can obtain another product as the case might require. However, this again would be subject to consumer opinion. Therefore, Ritchie cannot be forced by Layabout to accept another carpeting or service from them as a compensation for the previous product.
